Title Curative Services

Mortiles LLC., provides a complete suite of title curative services. Our experienced team of professionals drives the curative process from title review and issue discovery through non-judicial resolution, record correction, and perfection. Barriers to clear title are initially set forth by a claim made against a title insurance policy. Our first task upon referral is to validate each issue listed in the claim and review all available title documents for additional issues not listed. State laws are widely divergent; an issue clouding title in one state may not cloud title in another. Our clients and claimants are geographically dispersed, relying upon us as experts in determining real issues and real solutions tailored to the jurisdictions we service.

Title curative services inherently invite nonstandard issues, and complex and novel legal requirements. We approach and develop our strategies under a theory of continuous process improvement. Our clients have come to rely upon this evolutionary approach as it fosters a broad base of experience and facilitates an ability to rapidly adapt to changing conditions and requirements. As such, we are able to provide an expanded variety of services including but not limited to:


Federal & State Tax Lien Releases

Obtain release of Federal & State Tax Liens when the foreclosure attorney fails to provide adequate notice of sale. Fees which may be requested by the IRS are not included


Federal & State Tax Lien Subordination

Obtain release of Federal & State Tax Liens when the foreclosure attorney fails to provide adequate notice of sale. Fees which may be requested by the IRS are not included


Early Release of the IRS's Right of Redemption

Obtain early release of the IRS's right of redemption (120 days in most states) when seller has a contract and wishes to sell prior to the expiration of the redemption period. Fees which may be requested by the IRS are not included


SBA Loan Releases

Obtain release of SBA's 1 year right of redemption after foreclosure and prior to the 1 year expiration period. Fees which may be requested by the SBA are not included


Negotiations

Negotiation of all types of releases. We will prepare and obtain execution of a Quit Claim Deed or deed of release or partial release in order to clear a title defect, break in the chain of title, or estate issues, or Scrivener's Affidavits. Any amount requested by the lienor is not included.


Mechanics' and Materialmen's Liens

Negotiate release or payment of mechanics' and materialmen's liens. This includes negotiating an amount for payoff and drafting the release. Any amount requested by the lienor is not included.


Judgment Release

Negotiate release or payment of judgment liens when they attach to subject property after foreclosure. Will also draft the release as necessary


Redemption after Tax Sales

Negotiate tax sale redemption, prepare and have executed d the necessary documentation releasing said tax deed. Any amount requested by the deed holder is not included.


Title Policy Procurement

Provide us with a prior HUD and commitment and I will find the policy or have one reissued.


Letter of Indemnity/MIA

After finding the policy, will determine the quickest way to clear the outstanding issue


Title Claims

After exhausting all avenues of title clearance, will determine the correct documents needed to file a title claim. We will monitor progress with Title

Company through to the final resolution of the claim. The end result of the claim will be clear and insurable title.


File Clearance

If assistance is needed determining if liens attach, I will review and determine which attach and need to be cleared and which do not. I will send email with title clearance suggestions for any that do attach
